GO To Regularise Land Encroached By The Poor

In a move that would benefit thousands of poor people of the state, the Y S Rajasekhara Reddy government on Wednesday decided to regularise land encroached upon by third parties free of cost provided they produce relevant documents. The regularisation would also be allowed only if it has taken place before the Urban Land Ceiling Act was repealed on March 3 this year.

Third party is defined as those who have encroached upon government land and those to whom a person who had excess land, beyond permissible under the Urban Land Ceiling Act, sold the land. According to GO MS 747 issued on Wednesday, the government would regularise land encroached by the poor including the corporation areas free of cost.

Only those whose annual income is less than Rs 24,000 per annum will be eligible for the regularisation. While only 80 sq yard (67 sq metres) land would be given to the poor in big cities, it would be 100 sq yards in municipalities and 120 sq yards in village panchayats.

In Hyderabad and surroundings, land to the tune of 3,000 sq metres would be regularised if the encroacher had documents to prove that land was registered in his favour. While the maximum extent of land that could be regularised in Visakhapatnam and Vijayawada cities would be 4500 sq metres, it would be 6000 sq metres in Guntur and Warangal cities.

Production of electricity connection, construction permission and water supply connection is considered as the primary documents needed for such regularisation. The land in possession of third party in instances where there is a structure but where the occupation is not supported by any registered document of purchase would also be regularised.

By structure, the GO meant the raising of walls supported by RCC, tiles, AC sheets and zinc sheets. In places like Guntur, Vijayawada and Visakhapatnam, those who have built shanties by using palm leaves would also be regularised, the GO said.

According to insiders, the move is aimed at wooing the landless poor ahead of the 2009 general and assembly elections. “Thousands of poor encroachers in all major cities in the state would stand to benefit by this move,” said one official.

According to sources, the move was also prompted by the lack of substantial progress in the Indiramma housing project for the poor. The state government had planned to encash on the poor housing scheme and reap rewards in the elections, but several problems including slow land acquisition have resulted in the housing scheme progressing at a snail’s pace. Hence, the move to regularise land to the poor, they said.
