Urban Land Ceiling Act to go

Under intense pressure from the Municipal Administration Department and World Bank, the State Government seems to have made up its mind to scrap the Urban Land Ceiling (ULC) Act with effect from next financial year.

The file for repealing the Act is reportedly being circulated among the officials concerned for collecting their opinion. Once the process is complete, a Bill to scrap the legislation is likely to be introduced in the ongoing Budget session.

According to sources, the State Government has recently sought a status report from the Revenue Department about the pending applications for regularisation of structures on surplus lands by the third parties and land owners.

It may be recalled that two GOs - 455 and 456 - were issued in connection with the same issue in 2002. In their ‘Fact report,’ the revenue officials said that barring 2,000 cases, which were held up due to court litigations, the remaining 21,000 applications were cleared.

They also said that if the Act is repealed at this stage, the interest of the third parties would be affected. “All these 2,000 cases are in and around Hyderabad whereas applications in the remaining four urban agglomerates have already been cleared,” senior officials told this website’s newspaper.

The ULC Act is in vogue in five urban agglomerates - Hyderabad, Warangal, Guntur, Vijayawada and Visakhapatnam - and the Government has appointed special officers to deal with around 76,000 cases relating to around 10,000 hectares which were declared as surplus.

The World Bank, which has agreed to fund the AP Urban Basic Services Project, made it clear that the loan would be given only urban reforms like if repealing the ULC Act are implemented.

Even the Union Urban Development Ministry said that the State Government would be eligible to avail funds under the Jawaharlal Nehru National Urban Renewal Mission (JNNURM) if the ULC Act was scrapped.

However, the State Government has sought time from the World Bank till March 31 this year to repeal the Act on the ground that the interest of the third parties, who are in possession of the lands declared surplus, have to be protected by regularising their possession before repealing the Act.

Of the 76,000 cases, the Government has received 23,000 applications for regularisation of the structures on about 800 hectares during the last six years.

Besides, another 1,000 hectares were given to Government departments, weaker setion housing colonies and IT and new business companies to attract investment. By doing so, the State Government has earned a revenue of nearly Rs 500 crore.

    Dear Shireesh,

    The Act ULC,1976 has been repealed by the Central Government in the year 1999 and in only few states like A.P,Maharashtra, West Bengal the act is in force.Presently the Legislative assembly of A.P. and Maharashtra have consented to repeal the act in their respective states and is dew for Gagette notification.

    In A.P.the limit of urban land holding in core area is 1000 sq.mtrs and in peripheral area which notified under G.O.733 is Acres 5-00 Guntas (as per G.O.s455 and 456).If it is meant for Lay out 40% be exempted for amenities devel
