Consumer Forum Cracks Whip On Amulya Estate

In a judgment that sends warning signals to errant builders in the state, the AP state c o n s u m e r disputes redressal commission on Friday directed a builder - K Bhagawati, managing partner of M/s Amulya Estate, Hyderabad - to get the defects of three flats she sold in Anmol Residency apartments in Humayun Nagar in the city rectified and clear all the old dues connected to these flats within six weeks.

The commission comprising its president justice D Appa Rao and members Merla Shreesha and G Bhoopathi Reddy, while upholding the order pronounced by the Hyderabad district consumer forum, provided relief to the three flat owners by pronouncing the exact amount of compensation to be paid to them in this regard.

The aggrieved parties, Abdul Ghani, George Jacob and Dr Abdul Rub who purchased flats were in for a rude shock later when they found several defects in their flats. Though as per the sale agreement, the flats should have been handed over to them between December 2002 and April 2003, the builder failed to meet his commitment within the stipulated period.

The built-up area is 850 sft, 930 sft and 1210 sft respectively as was agreed upon. But there is a shortage of 20 percent in the area and no refund was given to them by the builder, the flat owners contended in their petition.

Though Rs.50,000 was collected from them towards car parking, no demarcation of space was made for the purpose.

Basic water supply and sewerage amenities were not provided. And in the name of clearing the old dues of the old houses that were existing in the site of the apartment prior to its construction, all the flat owners were made to pay an amount of Rs.1500 additionally though they were not under any obligation to clear such dues, the flat owners said in their petition.

The builder provided no borewell, no generator, left overhead tank and slab work unfinished and balconies were left without any pipes to drain out waste water, according to them. In spite of so many problems, they were forced to pay water and other bills.

The commission ordered the builder to rectify all the defects or bear the expenditure if the complainants get them repaired with the help of a qualified contractor.

It also directed the builder to clear all the dues and produce a ‘No dues certificate’ within six weeks.
