SC admits Jayabheri petition on ring road

The Supreme Court on Thursday extended its earlier stay on the construction of the Outer Ring Road in Hyderabad while admitting a special leave petition by Jayabheri real estate group and eight others opposing its realignment.
The SC took note of the Central Water Commission report on the presence of water bodies in the lands (survey numbers 291, 298, 299 and 300) through which the realigned ORR has to pass. These lands do not belong to Jayabheri group but are adjacent its property in Puppalaguda village. The counsel for the petitioners, Mr Harish Salve, told a bench comprising Justice Ashok Bhan and Justice Althamus Kabir that the Andhra Pradesh government had notified the water bodies under the zonal development plan. The ORR alignment was first announced in April 2005. In November 2005, the State Government came up with a new alignment and gave notices for acquiring lands in the abovesaid survey numbers.
Mr Fali S. Nariman, counsel for Huda and the state government, contended that water was present only in one lake (survey number 300) and a bridge would be built over it.
Jayabheri group chairman and cine-actor, Mr Murali Mohan, said that the AP High Court had earlier refused to stay the ORR construction. His group then filed two SLPs in the Supreme Court. Apart from Mr Salve, senior advocates, Mr Arun Jaitley and Mr Mukul Rohtagi, also appeared on behalf of the Jayabheri group.
